I would like to thank everyone for that also. If my understanding of how the filter works is wrong then it is my bust, and I am glad to admit it. I thought the filter worked on outgoing chat messages. It looks like that is incorrect. With that being the case then if you turned off the filter it would not be bypassing it.
I still have to wonder why the filter can be turned off if profanity is against the EULA...If someone can make sense of that for me I would be grateful!

I can answer that for you.
You are not allowed to generate profanity within the game, but Anet is. I can't name a character Damned Cleric, for example, but Anet can make an enemy with that name.
If I, as a player, want to read the name Damned Cleric, as put into the game by Anet, I need to turn off my filter.
That's why you can turn it off.

While the purpose of a chat filter is to filter out vulgarity, or words deemed inappropiate for younger audiences, there is no "perfect filter". There are often times where words are captured by the filter because they meet a character string that says, "This is bad. Block it." when really the word wasn't bad at all. Use your rhyming skills to see how that can happen. Also see some of the filtered names in the naming policy.
The option of being able to have it on, or off, isn't some sort of cheat for people. Those who are mature enough and responsible enough to both view and express themselves without engaging in excessive inappropiate language have the choice to turn the filter off for public conversations. It also means myself and friends, who are all over 25, can turn off the filter and chat like we're 25 within the means of our party, or guild, without the filter restriction.
Parents with young kids at the ripe of age of 13, who may not at all be responsible enough to handle it, be involved in it, or view it, can keep the filter on.
Whatever the choice, in the end, each player is still responsible for their actions.

It sounds stupid, but he does actually have a pretty good point.
Personally I think the whole chat filter stuff is kind of bad anyway. What's the point in having it, or being able to turn it off, if you can be banned for swearing anyway?

Just in case you missed it. You can't bypass the filter if it's not "there", i.e., actively filtering (turned on).
Another way to look at it is in your last comment in the OP: you can't "escape" the filter by turning it off, because to "escape" something the thing has to be there.

Another funny thing about the filter is the word "damn". It's filtered by the in-game filter, but when you ping a Damned Cleric it says damned. I want someone to say something like "Oh balthazar damnit" in all chat and see if they get banned, lol.
Also, discussing "naga's" can get you banned unless you speak of them in the right way. I remember several guilds such as Naga Stole Mah [Bike] and Kill The Nagas [WP] getting banned.

The filter is there because some people will swear even though they are not supposed to. So if a parent doesn't want their kid to see swearing, and has the chat filter turned on, the kid can sit in Kamadan and see people say "bitch", "shit", "fag", etc. and only get **** instead. Turning the filter off is a choice made because some people swear and don't mind seeing others do the same. There isn't a global chat monitor in place, so you will only get banned if reported or observed by a GM. And since we know how ofter GMs are around in the game, you see that you have to be reported.
